This is an Area-3 Violent Crimes/Sex Crimes Unit Arrest, Case Cleared-Closed by Arrest and Prosecution Report.

Event# 02303 - BWC Event

Reporting Detectives were assigned this investigation by the Area-3 Violent Crimes Sgt on-duty upon notification to the Area by the 001st District. R/Ds relocated from the Area to the scene where R/Ds interviewed involved CTA personnel.

Beat 0123 was assigned to a call of a person exposing themselves on the mazzanine level of the CTA Orange Line at 22 E. Roosevelt. Upon arrival of Beat 0123, a discovery was made through investigation that a woman was being assaulted on a CTA Orange Line train. 113 assigned to assist. 0123 was informed that the offender was in front car as train was pulling into the station. 0123 notified OEMC of this fact. 

Upon train arrival, Reporting Officers made contact with the victim and the CTA Train Operator who detained the offender. Victim identified offender at the scene. Beat 0113 advised offender in-custody at 7:35AM. 0113 transported offender from 22 E. Roosevelt to the 001st District. Starting mileage of 58911. 7:44AM was the time stamp at this point per OEMC. 

R/Ds then relocated to the 001st District and interviewed the victim, R/Os, and made contact with offender.

The female victim was in a seat on a CTA Orange Line train when a male offender she didn’t know made contact with her and offender began rubbing her genitalia with his hand. Victim told the male offender to stop, and offender told her, “I just wanted some. Give it to me".  Offender then pulled down the woman’s shirt and bra and began licking and kissing her breasts. Victim attempted to get up because she wanted to flee from offender, and offender used his body weight to push victim back down into the seat, and offender continued to lick and kiss her against her will. Victim then fought against offender enough that victim was able to produce her phone and call 911 and was able to pull the train’s emergency pull handle at the door.  Offender then pushed her to the floor upon victim attempting to speak with train operator.

Orange Line Train Operator then responded at the Roosevelt train station and physically detained the offender while using his radio to call CTA control to obtain police response.

Offender is now positively identified and known as GARCIA, RAUL, V

Further investigation revealed that offender is homeless and has no priors.

R/Ds obtained CTA video from platform and train victim was on with offender. R/Ds contacted the Cook County State's Attorney's Felony Review Unit who responded to the Area-3 Detective Division and reviewed all available case materials with R/Ds and approved the following charges against offender GARCIA, RAUL, V. 



Bond Court scheduled with Judge Mary Marubio. Offender held on $150,000 bail.
